Bill O’Reilly Loses Custody Battle in New York Court Ruling
Bill O’Reilly, the famous commentator, has lost shared custody of his two children, and now has parenting time on alternating weekends and on certain weeknights.
Although, Mr. O’Reilly is famous, the facts of his case and the Court’s decision is not that unusual. Originally, Mr. O’Reilly and his wife, agreed to equally share custody time with their children. In their agreement, the father and the mother had equal (50/50) time with their children.
Subsequently, as is often the case, one of the children decided that she wanted to spend less time with her father. Due to this “change of circumstances”, the mother requested a change in the custody arrangement.
The trial court (called the Supreme Court in New York State) awarded the mother primary residential custody of the children and Mr. O’Reilly’s custodial time was changed to alternating weekends, and visitation with his son from Wednesday until Friday and one night a week with his daughter.
Mr. O’Reilly appealed the trial court’s decision.
In evaluating the mother’s request, the Appellate court took into account the: (i) clearly stated preferences of the children; (ii) the children’s age and maturity (they are now 17 and 13); and (iii) the quality of the mother’s home environment. All of these factors are typically considered in any request for a change in custody.
Therefore, although, Mr. O’Reilly is famous, his case was decided in the usual fashion and there were no unusual determinations made by the Appeals Court.
