What One Judge Said To Divorcing Parents

By David P. Badanes, Esq.
Most everyone knows that in a divorce, it is best to keep the children out of the divorce “fight” and not to state malicious things about the other parent in front of the children. However, there are still divorcing parents who can’t (or will not) abide by these simple and wise rules. In one extreme case, the Judge stated the following to the fighting parents (in very explicit and start terms):
“The children love you both. This is not helping them. This is causing them to be upset. This is causing them to lose confidence in their relationships with both of you. They don’t want to hear that dad is a bastard. They don’t want to hear that mommy’s a bitch. That’s someone they love. And when you say something about someone they love, you hurt them. They don’t want to see you drunk. I don’t care what he did. I don’t care what she did. They can’t see that. They need a mother who is strong. They need a father who is strong. And they need a mother and father. I don’t care if you guys fight in private. I don’t care what you do in private. But you are not going to do it in front of these kids.”
Clearly, the parents in this case where engaging in very hurtful behavior. However, the Judge’s warnings in this case apply to every divorcing parent. If you love your children, you will not disparage your spouse in front of them (or while they are in the house, they hear everything).
