Marijuana Possession

The crime of marijuana possession depends on the amount you are found with.  Less than 25 grams or about a half an ounce of marijuana is a violation and carries a maximum fine of $100.00.  Although half an ounce of marijuana sounds like a very small amount, because marijuana, by itself, doesn’t weigh that much, it is enough to make about 10 to 15 “joints”.

If you are charged with possessing 25 grams to 1.9 ounces of marijuana, the maximum penalty is 3 months in jail and a $500 fine, and is classified as a misdemeanor.  If you are carrying between 1.9 ounces and 7.9 ounces, of marijuana, the maximum penalty is 1 year in jail and a $1,000 fine and is also classified as a misdemeanor.  Amounts greater than 8 ounces are charged as a felony and depending on the amount of marijuana, the maximum penalty can be as great as 15 years in jail and a $5,000.00 fine.
