If I am in the middle of a divorce, can I still move to a divorce mediator
You filed for a divorce and hired an attorney. You are now in the middle of the divorce process, but, you and your spouse have decided to use a divorce mediator. Can you do so?
The short answer is YES.
If you are in the middle of a divorce, you and your spouse can decide to use a divorce mediator at any time. Of course, you both should inform your respective attorneys and let them know that you have decided to use a divorce mediator. Most likely, you should not “cancel” or withdraw the divorce action. Instead, you should tell your attorney to put the divorce action on “hold” until the divorce mediation process is finished, or, until the divorce mediation process doesn’t work out.
In addition, when you go to the divorce mediator, you should tell the mediator that there is a pending divorce action.
The Court should be able to give you ample time to see if the divorce mediation process will work.
