Three Ways To Lose Custody of Your Child
David P. Badanes, Esq.
If you are involved in a custody battle, the following are three common ways to lose custody of your child:
1. Alcohol or Substance Abuse. If you have an existing alcohol or substance abuse problem, then you must seek treatment. If you engage in alcohol or substance abuse, especially in front of your children, then you are seriously jeopardizing your custody rights.
2. Verbal or Physical Attacks of the ex-spouse (especially in front of the children). Certainly, domestic violence will never be tolerated. When physical attacks occur in front of the children, you are multiplying the damage. Verbal attacks or engaging in derogatory remarks against your ex-spouse will have two negative effects. First, it will backlash against you, as this can be used against you in your attempt to gain custody. Second, it will have negative psychological effects as well.
3. Interfering with visitation. If there is a temporary visitation schedule and you interfere with your ex-spouse’s schedule, then your interference will be a negative factor in your custody battle.
