How Long Will My Divorce Take?

One of the first questions my clients ask me is “How long will my divorce take?” The answer is “it depends.” Each divorce is unique, so there is no set amount of time that a divorce action will take to complete. In addition, there are at least six factors that will affect each divorce:

1. Your attorney
2. Your spouse’s goals
3. Your personality
4. Your spouse’s personality
5. Your spouse’s attorney
6. The Judge

I will explore each one in reverse order.

The Judge: In Nassau and Suffolk County, several different judges handle divorce matters. Each Judge has his/her own unique way of how they handle a case. Some judges will try to speed things along, while other judges will let a case drag on.

Your Spouse’s Attorney: Some attorneys are known to delay a case, while other attorneys will cooperate in trying to expedite the case.

Your Spouse’s Personality: You know your spouse. Is your spouse someone who is going to fight over everything and anything and delay the case? Or, is your spouse someone who will try to work things out?

Your Personality: If you want a quick divorce, then you will need to cooperate with your attorney. If you want to delay the divorce, then you need to let your attorney know this.

Your Spouse’s Goals: If your spouse has unrealistic goals or if their goal is to delay the case, they may be able to slow down the process. An uncooperative spouse will most likely delay the case.
