Facebook, Social Media and Divorce

If you use Facebook, Twitter, Instagram or any of the other social media sites, then you should be aware that anything you post on your social media site can and will be used as evidence. Here are a few tips to keep in mind when you are using social media websites:

1. Delete your account now. I know this is a drastic step, however, it is easier to delete your Facebook, Twitter and other social media sites then it is to control what you may have on there or what you may post.

2. Do not post anything. Everything you post is public and available as evidence. What you may believe to be an “innocent” post, may not seem so innocent to a court. If you can’t delete your account, then do not post anything to your account.

3. Do not post photographs. If you must post, then at least do not post photographs. Again, photographs can be misconstrued.

4. Do not post your accomplishments or recent purchases. You just bought a new car or you are at an expensive restaurant and want to post this. Do not do it. Why give your ex-spouse ammunition?

5. Do not post anything about your ex-spouse. Your ex-spouse may be a jerk, but, there is no reason to post that on Facebook. If you have children, it is easy for an attorney to state that your negative postings about your ex-spouse is being read by your children and hurting them.
